Criminal liability for public officials who abuse authority in indonesian corruption law: distinguishing between administrative violations and criminal offenses

Abuse of authority by public officials is a criminal act that significantly undermines public trust and the integrity of government administration. This article analyzes the concept of criminal liability for officials who abuse their authority based on Indonesian criminal law, particularly under the Anti-Corruption Law and administrative law doctrines. This research employs a normative legal method using statutory, case law, and conceptual approaches. The findings show that criminal liability arises when the elements of unlawfulness, misuse of official authority, and intent to benefit oneself or another party are fulfilled. Furthermore, harmonization between administrative and criminal aspects is needed to prevent overlapping enforcement. This study recommends strengthening internal supervision and enhancing the integrity of public officials.
